2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 24.05.2023 passed in Cr. Misc. No. 28740 of 2023.
3. The petitioner seeks regular bail in a case registered for the offence under Section 395 of the Indian Penal Code and later on Sections 25(1-b)a, 26(i) (ii)/35 of the Arms Act was added.
4. The following order was passed on 24.05.2023 in Cr. Misc. No. 28740 of 2023:- Heard the learned counsel for the petitioner and learned counsel for the State. Let the defect(s), if any, be removed within a period of four weeks from today.
The petitioner seeks bail in connection with Kasim Bazar P.S. Case No. 01 of 2023
Patna High Court CR. MISC. No.29418 of 2024(2) dt.21-06-2024 2/2 registered for the offence under Section 395 of the Indian Penal Code and Section 25(1-b)a/26(i) (ii)/35 of the Arms Act.
The petitioner is said to have committed dacoity in the house of the informant.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the nature of allegation and the fact that the dacoity has committed in Munger Town, this Court is not inclined to grant bail to the petitioner for the present.
Accordingly, the prayer of bail of the petitioner is dismissed herewith.
5. No ground for review is made out.
6. Accordingly, this application for regular bail is hereby rejected.
7. The court below is directed to expedite the trial of the petitioner.
