The matter has been listed under the heading 'For Orders' under the orders of Hon'ble the Chief Justice. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in a case instituted for the offences under Sections 395 and 412 of the Indian Penal Code. Prosecution allegation, in short, is that while the informant was travelling, the accused persons came in the bogie of the train and looted cash, mobile and other articles from him. It has been submitted on behalf of the petitioners that the petitioners are in custody since 6.1.2020 and have got no criminal

Patna High Court CR. MISC. No.18874 of 2020(2) dt.10-06-2020 2/2 antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners and victim were travelling in the train. A quarrel took place between them for berth in the train and for the said reason, the petitioners have falsely been made accused in the present case. There is no recovery of arms from the possession of the petitioners.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the facts and circumstances of the case and also the lockdown, the petitioners above named, are directed to be released on bail on their personal bonds to the satisfaction of learned R.J.M., Kiul, Lakhisarai in connection with Rail Jhajha P.S. Case No. 19 of 2020.

Once the normalcy is restored, the petitioners shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each within a period of four weeks to the satisfaction of the Court concerned in connection with the aforesaid case.
