The petitioner apprehends his arrest in a case under section 498A of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife, although his wife has already married to someone else.
Considering the fact that the petitioner is ready to keep his wife, the petitioner is directed to surrender in the court below
Patna High Court Cr.Misc. No.49229 of 2014 (2) dt.06-04-2015 2 / 2 within four weeks from the date of receipt/production of a copy of this order, and the court below shall enlarge the petitioner on provisional bail, after issuing notice to the complainant, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to , Muzaffarpur, in connection with Complaint Case No. 2932 of 2011 corresponding to Tr.No. 2057/2013, subject to the conditions as laid down under section 438(2) Cr.P.C.
The court below shall thereafter make effort for resolution of the dispute between husband and wife, and if the dispute is resolved, the court below shall confirm the provisional bail. If the dispute is not resolved, the court below shall pass order on merit on the provisional bail.
