21-08-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Ara Nawada P.S. Case No. 978 of 2019, registered for the offence under Section 395, 397 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, two accused persons entered in the Gramin Bank and on the point of pistol, looted cash of Rs. 30,27,244/- (thirty lacs twenty seven thousand two hundred forty four).

It is submitted on behalf of petitioner that petitioner is not named in the FIR and his name has come on the confessional statement of co-accused. No incriminating article has been recovered from the possession of the petitioner and till date, he has not been put on T.I.Parade. Petitioner is in custody

Patna High Court CR. MISC. No.30410 of 2021(2) dt.21-08-2021 2/2 since 23.11.2019. Chargesheet has been submitted. However, learned A.P.P. for the State opposed the bail petition and submitted that out of looted amount, cash of Rs. 1,80,000/- has been recovered from the house of the petitioner and on the disclosure of this petitioner, one lady purse of a Bank employee namely Bandna Kumari has been recovered near a canal, which was identified by her.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
