This is the second attempt of the petitioner for grant of regular bail as earlier the bail application of the petitioner was rejected vide order dated 25.05.2023 passed in Cr. Misc. No. 13381 of 2023 which reads as under:- Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with S.Tr. No. 913 of 2022 arising out of Danapur P.S. Case No. 208 of 2022 registered under Sections 302, 120B and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Unknown criminals had fired indiscriminately upon the deceased and killed him. During investigation materials have come to connect

Patna High Court CR. MISC. No.31451 of 2024(5) dt.23-08-2024 2/2 the petitioner with the crime as one of the assailants of the deceased. The petitioner has two criminal antecedents also under Section 302 and under Section 27 of the Arms Act.

The trial of the case is going to be commenced as the charges have already been framed. Considering the fact that this is a case of brutal killing of a person in the town of Patna in which the petitioner's involvement has been found, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer of bail of the petitioner is rejected herewith.

The Court below is directed to expedite the trial.

Learned APP for the State has submitted that the trial has begun and three witnesses have already been examined. In the opinion of this Court, no ground of interference if made-out.

Accordingly, this application is dismissed.
