JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-09-2020 The Office has pointed out four defects but learned counsel of the petitioner undertakes that he will remove the defects when the Court starts physical functioning. Heard Mr. Vikramdeo Singh, learned counsel appearing for the petitioner as well as Mr. Navin Kumar Pandey, learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 19.7.2019 in connection with Sessions Trial No. 496 of 2019 (arising out of Chenari P.S. Case No. 176/2019) registered for the offences punishable under Sections 399, 400, 402, 414/34 of the Indian Penal Code.
Petitioner and some other were caught by the police when, allegedly, they assembled to make preparation for committing dacoity. Mobile sets and other articles were
Patna High Court CR. MISC. No.20830 of 2020(2) dt.10-09-2020 2/2 recovered but, admittedly, no firearm was recovered either from possession of the petitioner or from possession of other coaccused. It appears that petitioner does have criminal antecedents of four cases but in present case, except the above stated materials, there appears to be nothing against him. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XIII, Rohtas at Sasaram in connection with Sessions Trial No. 496 of 2019 (arising out of Chenari P.S. Case No. 176/2019). Petitioner shall remove the defects, as pointed out by the Office, within three weeks from the date when Court starts normal functioning, failing which the office shall put up this petition before an appropriate Bench.
