JUSTICE PARTHA SARTHY ORAL ORDER 08-06-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner who is in custody since 1.2.2020 has filed the instant application for grant of regular bail in connection with Buxar (Town) P.S. Case no. 52 of 2020 registered under sections 414 and 34 of the Indian Penal Code.
As per allegation in the FIR, it is stated that the motorcycle on which two persons were travelling was stopped and the accused persons thereon disclosed their name as Shivam Singh and Bhaskar Singh. It is further stated that on enquiry they did not produce any documents with respect to said motorcycle.
It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR and his name transpired in course of investigation on the confessional statement of co-accused Shivam Singh. It is further submitted that no incriminating article has been recovered
Patna High Court CR. MISC. No.19171 of 2020(2) dt.08-06-2020 2/2 from the possession of the petitioner and he is in custody since 1.2.2020. It is further submitted that one another coaccused namely Saroj has been enlarged on bail vide order dated 4.6.2020 passed in Cr. Misc. no. 19144 of 2019.
The application for bail is opposed by learned APP for the State.
Having heard learned counsel for the parties and in the facts and circumstances of the case including the grant of bail to the co-accused and the petitioner being in custody since 1.2.2020, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Buxar (Town) P.S. Case no. 52 of 2020 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
