The petitioner prays for anticipatory bail in connection with Hathua P.S. case no. 27 of 2015 registered for the offences punishable under Sections 120B, 420, 406, 467, 468 and 506 of the Indian Penal Code.

It has been submitted on behalf of petitioner that the petitioner has been named in the complaint petition on the basis of suspicion. F.I.R. has been lodged but nothing specific allegation has been attributed against the petitioner whereas the accused against whom the allegation of taking money has been attributed has already been enlarged on anticipatory bail by the Sessions Judge itself.

Having heard both sides and considering that the accused who was alleged to be taken the money has already been enlarged on bail by the Sessions Judge, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Gopalganj in connection with Hathua P.S. case no. 27 of 2015 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
