Petitioner seeks regular bail in connection with Kartaha P.S. Case No. 01 of 2021 registered for the offence under Sections Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Police has allegedly recovered 43.5 liters of illicit liquor from a motorcycle which was kept in the courtyard of the house of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has not committed any offence in the manner alleged. She further submits that motorcycle which was kept in the courtyard of the house does not belong to the petitioner and the house is a joint family property in which other family members also reside.

Patna High Court CR. MISC. No.31959 of 2021(4) dt.03-03-2022 2/2 Petitioner has got no criminal antecedent and he is in custody since 8 / 1/ 2021 and charge sheet has already been submitted. Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, charge sheet has already been submitted and trial is not likely to be concluded in near future due to COVID 19 pandemic, as such, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge- II- cumExcise Court, Vaishali at Hajipur in connection with Kartaha P.S. Case No. 01 of 2021.
