2. The petitioner seeks bail in connection with Bikramganj P.S. Case No. 431 of 2023 dated 01.08.2023, instituted for the offence punishable under Sections 147, 148, 149, 448, 323, 307, 302 & 504 of the Indian Penal Code.

3. The allegation against the petitioner is that he assaulted with spade on the head of informant's brother due to which he sustained injury on his head and lips. When the informant came to save his brother, then he was also assaulted by the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner as well as the

It is next submitted that the injury of the informant as well as his brother is not available in the case diary, which has been called for. Further submission is that so far the allegation of assaulting the mother of the informant is concerned, there is general and omnibus allegation against the petitioner. Lastly, it has been submitted that the petitioner is in custody since 09.08.2023, he has no criminal antecedents and charge-sheet has been submitted in the case.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ist District & Additional Sessions Judge, Rohtas at Sasaram in Bikramganj P.S. Case No. 431 of 2023.
