2. The petitioner has preferred this application for grant of regular bail in connection with Rosera P.S. Case no. 298 of 2025 registered under sections 137(2), 103, 238, 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. As per the prosecution case, the informant states that his brother who had gone out stating that he is going to meet the thekedar Sanjay did not return and was not to be found inspite of search.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case in course of investigation. It has transpired in the case diary that there was talk in the village that Sanjay had hired professional killers including the petitioner to carry out the occurrence. Learned counsel for the
Patna High Court CR. MISC. No.22293 of 2026(4) dt.15-07-2026 2/3 petitioner submits that seven persons have been named in the confessional statement. The petitioner has no concern with the alleged crime. The case of the petitioner stands on a similar footing to that of Md. Raja who has been enlarged on bail vide order dated 3.4.2026 passed in Cr. Misc. no.8162 of 2026 and of Vikash Kumar who has been enlarged on bail vide order dated 25.2.2026 passed in Cr. Misc. no.5205 of 2026. There is no eyewitness to the occurrence and the petitioner has no criminal antecedent. He is in custody since 24.9.2025 and chargesheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, name of the petitioner transpiring in course of investigation in the confessional statement of a co-accused made before police, there being no eyewitness to the occurrence, the petitioner not having any criminal antecedent, his being in custody since 24.9.2025 and grant of bail to the aforesaid two co-accused namely Md. Raja and Vikash Kumar, in the facts of the case, the Court directs the petitioner to be enlarged on bail in connection with Rosera P.S. Case no. 298 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like
