The petition is for restoration of Cr. Misc. No. 30498 of 2016. Learned counsel for the petitioner submits that he was ill therefore he could not appear and consequently Cr. Misc. No. 30498 of 2016 was dismissed for non-prosecution. Considering the facts aforesaid that on account of illness of learned counsel for the petitioner, the case was dismissed for non prosecution, the restoration petition is allowed. Accordingly, Cr. Misc. No. 30498 of 2016 is restored to its original file.
