13-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. for the State through video conferencing. This relates to grant of bail in Sessions Trial No. 852 of 2017/Reg.No. 376 of 2017, arising out of Chak Mahesi P.S. Case No. 21 of 2016, registered for the offence under Sections 302/34 of the Indian Penal Code.

Earlier, vide order dated 08-06-2020, a report was called for from the court below regarding current stage of the trial, which has been received and kept at flag 'A'. From perusal of report, as contained in letter no. 90/2020 dated 15-06-2020, it appears that in this case, charge was framed on 23-02-2018 and altogether six prosecution witnesses have already been examined and informant alongwith two medical officers and three police officials are to be examined.

Patna High Court CR. MISC. No.19039 of 2020(3) dt.13-07-2020 2/2 Considering the fact that trial is already going on and only a few witnesses have been left to be examined, I am not inclined to grant bail to the petitioner and as such, the bail application is rejected. However, while rejecting the bail application, the learned trial court is directed to conclude the trial as early as possible.
