====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 23-04-2025 Heard Mr. Hasnain Haider, learned counsel appearing on behalf of the petitioners and Mr. Anil Prasad Singh, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Shyampur Bhatha P.S. Case No. 34 of 2023 registered for the offence punishable under Sections 302/304B/34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the petitioners along with other accused persons strangulated the daughter of the informant and had thrown the dead body in the Bagmati River.

4. Learned counsel appearing on behalf of the petitioners submitted that the husband of the deceased is in custody. The petitioner no.1 is the mother-in-law of the deceased, petitioner no.2 is the brother-in-law (dewar) of the deceased and petitioner no.3 is the sister of petitioner no.1. They have no concern with the affairs of the deceased and her husband.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

6. Considering the nature of allegation made against the petitioner nos. 1 and 3, who are sisters, petitioner no.1 is the mother-in-law of the deceased and petitioner no.3 is the sister of petitioner no.1, I am not inclined to enlarge the petitioner nos. 1 and 3 on pre-arrest bail.

7. Allegation against petitioner no.2 is that he had convinced the daughter of the informant to attend ceremony in his family and after several months the dead body of the daughter of the informant was found floating in the stream of the river Bagmati. I find that there is no direct involvement of petitioner no.2 in commission of alleged murder of the daughter of the informant.

8. The petitioner no.2 Sanjeev Sahni is directed to be released on pre-arrest bail, in the event of his arrest or surrender

No.21743 of 2025(2) dt.23-04-2025 3/3 before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal Sessions Judge, Sheohar in connection with Shyampur Bhatha P.S. Case No. 34 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

9. The bail application stands disposed of.
