JUSTICE ANIL KUMAR SINHA ORAL ORDER 14-05-2020 Heard Mr. Vinod Kumar, learned counsel for the petitioner and Mr. Nawal Kishore Prasad, learned counsel appearing for the State, through video conferencing. The petitioner seeks regular bail in connection with Bodhgaya P.S. Case No. 71 of 2020, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that police intercepted a Honda Scooty and recovered a total quantity of 25.125 litres of illicit liquor.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent and has falsely been implicated in this case by the police with oblique motive. Learned counsel further submits that the petitioner is in custody

Having heard learned counsel for the parties and taking into consideration the fact that the petitioner has got no criminal antecedent and he is in custody since 28.02.2020, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Bodhgaya P.S. Case No. 71 of 2020. It is made clear that at the time of furnishing bail bond all the parties shall follow the guidelines regarding lockdown and social distancing.
