In this case, the petitioner is apprehending his arrest in connection with Goraul P.S. Case No. 97 of 2012 (G.R. No. 1448 of 2012) registered for offences under sections 304(B), 201 and 34 of the Indian Penal Code.
An allegation has been made in the First Information Report that the victim lady was caught fire and she was brought to hospital where she remained for treatment for about 28 days, whereafter, she was brought to her in-law's house. An allegation has been made that on 6.4.2012, one Surendra Ram on the instruction of Prabhu Sahni has transmitted the poison through injection. The statement has been given by the victim in the hospital that while cooking food, she caught fire and
Patna High Court Cr.Misc. No.14146 of 2017 (5) dt.19-08-2017 got burn injury.
Learned counsel for the petitioner submits that there is no allegation made by the victim that she was burnt by any family member rather an allegation has been made by the Informant that one Surendra Ram has transmitted poison through injection and there is no role of the present petitioner. Looking to the entire facts and circumstances of the case, let the petitioner, namely, Chandan Kumar Shani @ Chandan Kumar Sahni, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hazipur, Vaishali in connection with Goraul P.S. Case No. 97 of 2012 (G.R. No.
1448 of 2012), subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
