The petitioners apprehend their arrest in Pauthu P.S. Case No. 79 of 2016 instituted for the offence under Section (s) 147, 341, 323, 307, 379, 448, 504 of the Indian Penal Code. There is allegation against petitioner No. 1 of assaulting the informant with lathi on his head. There is no specific overt act against petitioner No. 2.

The injury report of the informant has been brought on record as Annexure-2 which reflects that there is no injury on the vital part of the body and the injury has been found to be simple in nature.

It has been submitted on behalf of the petitioners that petitioners and informants are cousin brothers and

In the facts and circumstances of the case, the prayer of the petitioners for anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, above named, within six weeks from today in connection with Pauthu P.S. Case No. 79 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
