JUSTICE SANJAY PRIYA ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Banka (Barahat) P.S. Case No. 903/2016 instituted for the offence under sections 366(A)/34 of the Indian Penal Code. It is alleged that daughter of the informant aged 18 years was not available in her house and on enquiry, it was learnt that she was seen with this petitioner.

After recovery, the victim girl gave her statement under section 164 Cr.P.C. wherein she has stated that this petitioner has taken her with intention to marry her and also established physical relationship with her. He kept her for four days. Thereafter, she was left free by the petitioner after arrival of the police.

Patna High Court Cr.Misc. No.9639 of 2017 (2) dt.08-03-2017 2/2 In such circumstances, this court does not find it a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail is rejected. However, the petitioners are directed to surrender before the court below and seek regular bail which shall be considered and disposed off on its own merit without being prejudiced by this order.
