The petitioner is apprehending his arrest in connection with Mojahidpur (Babharganj) P.S.Cae no.218 of 2018 , registered for offences punishable under Sections 7 of the E.C. Act and further Section 406 and 420/34 of the Indian Penal Code and Section 5 of Explosive Act, 1884..
Allegation against the petitioner as per the FIR is that the father of the petitioner kept 37 domestic gas cylinders in the house of Santosh Kumar and he was arrested and the father of Babloo Roy is the employee of M/S K.C. Gas Agency of which the petitioner if owner.
Submission of the learned counsel for the petitioner is that the whole allegation is against one Babloo Roy and against
Patna High Court CR. MISC. No.19022 of 2019(2) dt.06-05-2019 2/2 Santosh Kumar.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Bhagalpur in connection with Majahidpur (Babbarganj) P.S.Case No.218 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid direction, this application is allowed.
