1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Nimachak Bathani P.S. Case no. 36 of 2022 registered under sections 307, 341,323, 504, 506 and 34 of the Indian Penal Code.

3. As per the prosecution case, it is submitted that over a dispute relating to playing of vulgar sons on D.J. and throwing of water, it is stated that there was altercation between the parties. It is further stated that the accused persons variously armed assaulted the informant and others. It is stated that the petitioner and one another misbehaved with one Manju Devi and further the petitioner is said to have assaulted Jalandhar Kumar.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.19878 of 2025(2) dt.23-04-2025 2/2 that the petitioner has been falsely implicated in the case. Referring to the contents of the FIR it is submitted that the allegations so far as this petitioner is concerned, are general and omnibus in nature. The injury attributable to this petitioner on Jalandhar Kumar has been found to be simple in nature. The petitioner is in custody since 9.1.2025 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the injury on Jalandhar Kumar attributable to the petitioner having been found to be simple together with the petitioner having remained in custody since 9.1.2025 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Nimachak Bathani P.S. Case no. 36 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Gaya.
