Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.
One suspected stolen motorcycle was recovered from the house of co-accused Pankaj Kumar Singh. The family members of Pankaj Kumar Singh disclosed that Pankaj Kumar Singh purchased the seized motorcycle from the petitioner.
It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that petitioner sold the motorcycle to Pankaj Kumar Singh and only on oral statement the petitioner has been roped in the present case. It is further submitted that Pankaj Kumar Singh has been
Patna High Court Cr.Misc. No.37517 of 2015 (2) dt.17-09-2015 2/2 granted anticipatory bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 41067 of 2013.
Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka (Barahat) P.S. Case No. 208 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
