The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 25.02.2014 passed in Cri. Misc. No. 37658 of 2013, on the ground that as a matter of fact no amount was defalcated, the money withdrawn was disbursed through cheques and after due accounting it can be found that there was no defalcation. The petitioner has already been superannuated and, as such, he deserves sympathetic consideration.

The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances stated above, I am not

Patna High Court Cr.Misc. No.18348 of 2017 (3) dt.22-06-2017 2/2 inclined to re-consider the prayer of pre-arrest bail of the petitioner which has already been rejected and thereafter the prayer of pre-arrest bail of the petitioner stands rejected in connection with Khagaria P.S. Case No. 330 of 2013 pending in the court of learned Chief Judicial Magistrate, Khagaria. However, in case and if so advised the petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered preferably on the same day on its own merits without being prejudiced by the order of this Court.
