Petitioner apprehends arrest in connection with Complaint Case No. 2676 of 2018 registered for the offence punishable under sections 406, 420 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. During investigation, no material has come against this petitioner and after investigation police has submitted the final form (Annexure-2). As a matter of fact, petitioner never

No.24712 of 2019(2) dt.18-04-2019 2/2 received any money from the complainant and the complainant has given loan to M/s Nathi Lal Chand Umesh Chand in whose account the payment was made by the complainant, with which petitioner has no concern, as would be evident from the relevant extract of the bank account, as contained in Annexure-2 to the supplementary affidavit filed on behalf of the petitioner. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, I, Muzaffarpur (East), in connection with Complaint Case No. 2676 of 2018 corresponding to Trial No. 676 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
