The petitioner prays for grant of regular bail in Industrial Area P.S. Case No. 47 of the Bihar Excise (Amendment) Act, 2016.

In substance, the allegation is that on search 15 bottles of Royal Stag each containing 750ml. was recovered from the air bag of the petitioner. Similarly, India Made Foreign Liquor was also recovered from the possession of two other co-accuseds persons cited in the First Information Report. It is submitted that the petitioner is in custody since 18.07.2016. The charge sheet has already been submitted in the case. The petitioner has no criminal antecedent. The two other co-accuseds persons of the case has already been released on bail

Patna High Court Cr.Misc. No.47742 of 2016 (2) dt.09-11-2016 2/2 vide order dated 04.10.2016 passed in Cr. Misc. No. 44015 of 2016 and order dated 17.10.2016 passed in Cr. Misc. No. 44382 of 2016.

Considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Bhagalpur in Industrial Area P.S. Case No. 47 of 2016 subject to the condition that one of the bailors shall be his own/close family member. The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
