JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-03-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Barun P.S. Case No. 186 of 2016, registered for the offences punishable under Sections 448, 341, 323, 324, 308, 379, 506, 504/34 of the Indian Penal Code.

Allegedly, the petitioners no. 1, 2, 4 and 5 started assaulting the informant with lathi, danda and abused her also and when mother-in-law came for rescue then co-accused Binod Singh, the petitioner no.3, Anuj Singh, Santu Kumar and Ritu Kumar came and assaulted Birbal and Rajkumar, the son and Jaut of the informant and further gave spear blow and Sunil Singh snatched chain.

Patna High Court Cr.Misc. No.12311 of 2017 (2) dt.24-03-2017 2/2 Submission is of false implication and that the informant Manju Devi has received three injuries out of which injury no.3 is complaint of body ache and all the injuries have been caused by hard and blunt substance, no spear injury has been found on her person, superficial injuries have been found on her body, injury nos. 2 and 3 are simple in nurture and regarding injury no.1, opinion is kept reserved which is lacerated wound 1" x 1/10" into skin deep on left parietal region, and as such the petitioners deserve sympathetic consideration. The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 186 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
