JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-04-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the respondents. Petitioner is apprehending construction over his Raiyati land without following the procedure of acquisition. The Court on the basis of such apprehension cannot proceed and decide the present application as there is no material to arrive at a conclusion that the respondent proposes to make construction over the Raiyati land of the petitioner. In the event, the official respondents wishes to use Raiyati land of the petitioner, they are supposed to give opportunity of hearing to the petitioner before using the same for construction.

With the aforesaid observation the present application stands disposed of.
