JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioners and learned counsel representing the State.

The petitioners apprehend their arrest in connection with Sono P.S. Case No. 200 of 2016, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504 of the Indian Penal Code.

Allegedly, when the informant was preparing oven, the petitioners and other co-accused came and assaulted the informant and the petitioner no.1 and 2 took away deck and bucket.

Submission is of false implication and that there is

Patna High Court Cr.Misc. No.19074 of 2017 (2) dt.24-05-2017 2/2 case and counter case, now good sense has prevailed between the parties and both parties have compromised the case and compromise petition has been filed in the Court below, on the basis of compromise other co-accused have been allowed regular bail by the court below itself. The certified copy of which is filed today and that is kept on record and, as such, the petitioners deserve sympathetic consideration.

The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, the petitioners in the event of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Jamui, in connection with Sono P.S. Case No. 200 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
