2. The petitioners apprehend their arrest in connection with Ara Town P.S. Case No. 1054 of 2023 registered under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
3. The prosecution story, in brief, is that petitioners along with other co-accused persons came at the door of the informant and started abusing him. On protest by the informant and his family members, all the accused persons assaulted them due to
Patna High Court CR. MISC. No.25217 of 2024(3) dt.25-06-2024 2/2 which they sustained injuries. It is further alleged that accused persons also snatched gold ornament worth Rs. 50,000/- from the neck of informant's wife.
4. Learned counsel appearing on behalf of the petitioners submits that due to enmity arising out of land dispute a simple scuffle took place between the parties. Further submission is that there is case and counter case. Both the parties are agnates. Petitioners claim clean antecedent.
5. Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 1054 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
