The petitioner seeks bail in Siwan Mahila P.S. Case No. 11 of 2019, instituted for the offence under Section(s) 376 (D.B.) of Indian Penal Code, Sections 4, 6 and 8 of POCSO Act.

It is alleged in the written report that Kundan Kumar Choudhary and Balmiki Sah took daughter of the informant and committed rape with her. The allegation against this petitioner is that he gave threat to the informant for not lodging the case. As such, there is no allegation of any specific overt act against the petitioner in the written report. Petitioner is in custody since 2.2.2019 having clean antecedent.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge, Siwan, in connection with Siwan Mahila P.S. Case No. 11 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
