JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Mohammadpur P.S. Case No.14 of 2020 registered under Sections 451, 376 and 511 of the Indian Penal Code.

The accusation is that on 15.01.2020, the petitioner entered into the house of the informant Jaleshwar Manjhi and tried to unfold the Salwar of the daughter of the informant, aged about 19 years, for bad purpose. When the daughter of the informant tried to flee away, then she was dashed by the petitioner and then the petitioner started to unfold her cloth and torn her cloth. On the alarm being raised by the daughter of the informant, the informant along with others entered into the house and saved his daughter. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.18685 of 2020(2) dt.09-06-2020 2/2 submits that, in fact, there was love affair in between the petitioner and the daughter of the informant, aged about 19 years, as detailed in the F.I.R., but the informant was not ready to perform the marriage of his daughter with the petitioner. In the statement, recorded under Section 164 of the Code of Criminal Procedure, the daughter of the informant gave the similar statement. Further submission is that after realizing the mistake, the informant has also filed compromise petition in the court of the Chief Judicial Magistrate, Gopalganj. The petitioner is in custody since 16.01.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Gopalganj, in connection with Mohammadpur P.S. Case No.14 of 2020.
