JUSTICE ARUN KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Marhowrah P.S. Case No.36 of 2017 registered under Sections 341/323/379/504/34 of the Indian Penal Code.
Allegation in brief is that the informant after withdrawing Rs.4000/- was returning back along with his wife and when he reached near his house then all the accused persons started abusing and Suraj Sah took money from his pocket and assaulted. It is also alleged that Krishna Sah gave iron rod blow over his head.
Learned counsel for the petitioner submits that allegation is false and fabricated levelled due to land dispute and there is a case and counter case, the petitioner's side lodged the First
Patna High Court Cr.Misc. No.15249 of 2017 (2) dt.12-04-2017 2 / 2 Information Report after five days. Moreover, the injury attributed to the petitioner, is said to be single blow and that too is simple in nature and this petitioner has got clean antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely Krishna Sah, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2nd, Saran at Chapra in connection with Marhowrah P.S. Case No.36 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
