The petitioner is apprehending his arrest in connection with Ahiyapur P.S.Case No. 397 of 2016 registered for the offences punishable under Sections 498, 498A, 366, 367 and 120B of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the whole allegation is false, which will appear from Annexure-3. Petitioner has taken his wife along with him and they are living together and, as such, this false case has been filed. Heard learned APP also.
Having heard both sides and considering the materials on record, let the petitioner, above named, in the event of his arrest or surrender in the court below within a period of two weeks from
Patna High Court Cr.Misc. No.8506 of 2017 (2) dt.28-02-2017 2/2 the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S.Case No. 397 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further subject to the conditions that petitioner will co-operate in investigation and f he fails to do so, his bail bond shall be liable to be cancelled.
With the above observation, this application is allowed.
