Petitioner is an accused in connection with Rupaspur P.S. Case No. 42 of 2020 for the offence registered under Sections 399, 402 of the Indian Penal Code section 25(1-b)/ 26/35 of the Arms Act and 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case due to ulterior motive. Only two live cartridges have been recovered from the petitioner. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 03.02.2020.
