====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 03-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bishambharpur P.S. Case No. 09 of 2019, instituted for the offence under Section(s) 414 of Indian Penal Code and Section 7 of Essential Commodities Act.

It is alleged in the written report that 100 litres of kerosene oil has been recovered from the Motorcycle. The alleged Motorycle belongs to the petitioner.

Counsel for the petitioner submits that petitioner is in custody since 12.2.2019 having clean antecedent. He further submits that there is no evidence on record to show that aforesaid kerosene oil was stolen one.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Gopalganj, in connection with Bishambharpur P.S. Case No. 09 of 2019,subject to the condition that both the bailors will be close relatives of the petitioner.
