JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 25.02.2016 passed in Cr. Misc. No. 52403 of 2015 on the ground that the petitioner is suffering in custody since 03.02.2015, other co-accused has been allowed bail and in near future the trial is not likely to be concluded and as such the petitioner deserves sympathetic consideration.

The learned A.P.P. opposes prayer for bail by submitting that the petitioner is the assailant and he has got criminal antecedent also.

In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer

Patna High Court Cr.Misc. No.54730 of 2016 (2) dt.21-12-2016 2/2 for bail of the petitioner stands rejected in connection with Atri P.S. Case No. 05 of 2015 pending in the court of C.J.M. Gaya. However, considering detention of the petitioner, let the trial be expedited and concluded as early as possible preferably within a period of nine months from the date of receipt/production of a copy of this order.
