The petitioner seeks bail in Mahila P. S. Case No. 51 of 2018 instituted for the offence under Section(s) 376, 506, 365, 313/34 of the Indian Penal Code and Section 4 of the POCSO Act.

In the written report, it is alleged that there is specific allegation against co-accused Md. Mejar of committing rape with the informant on account of which she became pregnant. It is further alleged that when the accused persons including the petitioner came to know about the informant being pregnant they forcibly kidnapped her, took her to Malda and got her pregnancy terminated with the help of a lady, namely, Pinki. Petitioner is alleged to be driver of the vehicle by

The victim girl has given her statement U/s 164 Cr.P.C., wherein, she has levelled specific allegation against co- -accused Md. Mejar.

Petitioner is in custody since 25.1.2019 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Spl. Judge, Katihar, Dist. Katihar in connection with Mahila P. S. Case No. 51 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
