JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-10-2018 The petitioner seeks regular bail in connection with Kotwali (Tilkamanjhi) P.S. Case No. 527/17, registered for offences punishable under Section 395 of the Indian Penal Code. Allegation against the petitioner that he along with others entered inside the house of the informant and looted away cash and ornaments. Apart from that it appears that petitioner is an accused in six other cases.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R. his name has surfaced on the confession of co-accused and except that there is nothing against him and he has been in judicial custody since 21.02.2018 Learned counsel for the State opposed the prayer for bail on the ground that petitioner is an accused in other cases also.
Patna High Court Cr.Misc. No.64427 of 2018 (2) dt.29-10-2018 Having heard both sides, considering the aforementioned facts and circumstances as well as the criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner on bail. However, petitioner may renew his prayer for bail after framing of charge in this case.
