Let the defect(s), if any, be removed within a period of four weeks.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 498(A), 506 and 379/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 1 is the married Nanad and petitioner no. 2 is the sister-in-law of the informant. The informant alleges that she was married to Pradip Yadav and out of the wedlock a child was born but later the husband of the informant started demanding Rs.1,00,000/- and a motorcycle
Patna High Court CR. MISC. No.21009 of 2022(2) dt.02-11-2022 2/2 and on account of non-fulfillment of the same the accused persons including the petitioners started torturing and assaulted her and on 09.08.2020 the husband of the informant ousted her from her matrimonial home.
Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case. It is further submitted that the thrust of the allegation hinges around the husband of the informant and the petitioners being family members have been falsely roped in the present case.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Naugachia (Mahila) P.S. Case No. 21 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
