JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272/272 of the Indian Penal Code and 30(A) of the Bihar Excise Prevention Act 2016. Near about 25 liters Indian made foreign liquor were recovered from the dickey of vehicle of the petitioner but submission on behalf of the petitioner is that the aforesaid seized liquor was being carried by his driver and the petitioner was not in the aforesaid vehicle at the time of alleged recovery. Regard being had to the facts and circumstances of the case, I am not inclined to extend privilege of anticipatory bail to the petitioner and, accordingly, his prayer for anticipatory

Patna High Court Cr.Misc. No.64501 of 2018(2) dt.12-12-2018 2/2 bail in connection with Raniganj P.S.Case No. 292 of 2018, pending in the court of 2nd Additional Sessions Judge cum Special Judge, Araria stands rejected.

However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
