The petitioner seeks regular bail in connection with Hathauri P.S. Case No. 25 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, nothing has been recovered from the conscious possession of the petitioner. As a matter of fact, the petitioner has not been named in the F.I.R. and he being the owner of the alleged motorcycle has falsely been implicated in this case. The petitioner is languishing in judicial custody since 16.02.2020.
