Heard learned counsel for the parties.

Petitioner is an accused in a case registered for offence punishable under Section 394 of the IPC and 27 Arms Act.

Prosecution case is that two unknown persons stopped the informant's motorcycle and looted away the motorcycle, bag containing papers and cash etc. from the informant and fled away with motorcycle.

It is submitted on behalf of the petitioner that the petitioner is not named in this case and nothing incriminating has recovered from his possession to connect him with the

Patna High Court CR. MISC. No. 18747 of 2020(2) dt.04-06-2020 2/2 offence and no Test Identification Parade has been held till date. Chargesheet has already been submitted. Petitioner is in custody since 03.10.2019.

Let the appellant, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M. Sitamarhi in Sitamarhi Police Station Case No. 400 of 2019, on the following conditions:-

(1) Appellant shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on his absence on two consecutive dates without sufficient reason, their bail-bonds shall be cancelled by the Court below.

(2) If the appellant tampers with the evidence of witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
