2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 406, 409, 420 and 34 of the Indian Penal Code.
3. As per prosecution story, the informant, a Panchayat Secretary of Gram Panchayat Jitapur in the District of Madhepura, alleged that the then Mukhiya (petitioner herein) and the Panchayat Sachiv defalcated the Government amount to the tune of Rs. 45,00,000/- (Forty Five Lakhs). This led to lodging of the present F.I.R..
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

However, it is submitted that at this stage, without admitting her guilt, petitioner is ready to deposit half of the alleged defalcated amount amounting to Rs. 22,50,000/- (Twenty Two Lakhs and Fifty Thousand) and she shall be co-operating in the investigation. It is further submitted that similarly situated co-accused person, namely Sitaram Ram, has already been granted privilege of anticipatory bail by a Coordinate Bench of this Hon'ble Court vide order dated 18.04.2025 passed in Cr. Misc. No. 22275 of 2025. Petitioner is a lady and claims clean antecedents.
5. Considering the facts and circumstances of the case, claim based on parity, clean antecedents and aforesaid undertaking of the petitioner, prayer for grant of anticipatory bail to the petitioner is allowed.
6. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Madhepura in connection with Murliganj P.S. Case No. 228 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure, along with the following terms and

A. At the time of furnishing bail-bond, petitioner shall submit a demand draft of Rs. 22,50,000/- (Twenty Two Lakhs and Fifty Thousand) issued by the local State Bank of India Branch addressed to the Deputy Development Commissioner and shall be submitting it before the learned Trial Court. After checking the credentials, the same shall be handed over to the appropriate authority, in accordance with law.
B. The petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself .
7. It is made clear that without going into the merit of the case, the aforesaid order has been passed only for the purpose of grant of bail.
