The petitioner seeks regular bail in Kargahar P.S. Case No. 132/2016 registered under Sections 363 and 366A of the Indian Penal Code.

The informant alleged that the petitioner and others enticed his daughter for the purpose of marriage. Sri Vikramdeo Singh, learned counsel for the petitioner, submits that the victim made her statement under Section 164 of the Code of Criminal Procedure and she disclosed that the petitioner enticed her to Gujarat and established physical relation with her. It has further been submitted that the doctor examined the victim but did not find any sign of rape. The doctor assessed the age of the victim between 18-19 years but it appears that the victim disclosed her

Patna High Court Cr.Misc. No.48279 of 2016 (2) dt.12-01-2017 2/2 age to be 12 years. The court also assessed the age of the victim to be 12 years.

Considering the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on bail in Kargahar P.S. Case No. 132/2016 at this stage. Accordingly, the prayer for bail is rejected.

It is trial is not concluded within six months, the petitioner may renew his prayer for bail.
