2. The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 127(2), 115(2), 109, 352, 351(2)(3), 3(5) of Bharatiya Nyay Sanhita and Section 27 of Arms Act.

3. The prosecution case, in brief, is that while the informant was on his way to home, he was allegedly surrounded by the petitioners along with other co-accused

Patna High Court CR. MISC. No.27638 of 2025(3) dt.26-05-2025 2/3 persons. It is further alleged that the accused were variously armed and threatened the informant with dire consequences. During the course of the incident, coaccused Ranvir Yadav, son of Subhash Yadav, is alleged to have fired at the informant, causing him a firearm injury to his chest. Additionally, all the accused persons are alleged to have physically assaulted the informant.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case owing to previous enmity and local political rivalry. It is submitted that the allegations against the petitioners are general and omnibus in nature, merely attributing their presence as part of an unlawful assembly. The specific allegation of shot fire, resulting in a gunshot injury to the informant's chest, is solely attributed to co-accused Ranvir Yadav (son of Subhash Yadav). It is further submitted that after completing the investigation, charge-sheet has been submitted in the matter. The petitioners are languishing

Patna High Court CR. MISC. No.27638 of 2025(3) dt.26-05-2025 3/3 in judicial custody since 09.01.2025.

5. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Muffasil P.S. Case No. 04 of 2025 (G.R. No. 50 of 2025) on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria.
