Petitioner, who is in custody, seeks bail in connection with (Patna City) Bypass P.S. Case No. 235 of 2018 registered for the offences punishable under Sections 379, 411, 413, 414 and 34 of the Indian Penal Code.
Allegation against petitioner is recovery of 12 bottle of foreign liquor containing 350 ml. each from the bag which was carried by the petitioner and other co-accused on a motorcycle.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. The alleged motorcycle and alleged recovery does not concern petitioner. Nothing has
Patna High Court Cr.Misc. No.66399 of 2018(2) dt.01-11-2018 2/2 been recovered from the possession of the petitioner. It has been further submitted that similarly placed co-accused has been granted bail by another co-ordinate Bench of this Court in Cr. Misc. No. 60241 of 2018 vide order dated 06.10.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 7280 of 2018 arising out of (Patna City) P.S. Case No. 235 of 2018.
