Petitioner is languishing in custody since 21.05.2016 in connection with Madanpur P.S. Case No. 64 of 2016 for offences punishable under Sections 25(1-B)a/26/35 of the Arms Act and 17 of the C.L.A Act.

Co-accused Akhilesh Yadav disclosed to the police that he had handed over pistol and cartridges to the petitioner at the house of the petitioner. Thereafter, house of the petitioner was raided and a country made pistol as well as cartridges were recovered. Submission of the petitioner is that the petitioner has got no criminal antecedent. He has falsely been implicated as he has relation with co-accused Akhilesh Yadav. In fact the firearm has

Patna High Court Cr.Misc. No.43730 of 2016 (3) dt.19-12-2016 2/2 been planted to harass the petitioner. The petitioner is in custody since 21.05.2016.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad/Successor Court, in connection with Madanpur P.S. Case no. 64 of 2016.
