Mr.Arvind Kumar Pandey(APP-84) ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 27-06-2023 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Section 304(B)/ 34 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners have antecedent of one case and are mother in-law and father in-law of the deceased. It is next submitted that the petitioners earlier came to be implicated by the deceased in a case under Section 498-A of the I.P.C. The learned counsel for the petitioners submits that

Patna High Court CR. MISC. No.20944 of 2023(2) dt.27-06-2023 2/3 petitioners have been falsely implicated in the present case being father in-law and mother in-law of the deceased. It is next submitted that even from perusal of the allegation as alleged in the F.I.R., it would manifest that the demand of dowry is general and omnibus in nature. It is next submitted that the informant alleges that Rs.50,000/- and a motorcycle was being demanded, but then the allegation does not specify, who were accused, who were demanding the dowry. It is further submitted that the husband is in custody and whenever such occurrence takes place, the entire family members are implicated. It is also submitted that petitioners will not abscond rather will cooperate in the investigation. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned
