The petitioner apprehends his arrest in Bathanaha P.S. Case No. 30 of 2014 registered under section 307 and other allied sections of the Indian Penal Code. The informant has made very specific allegation that the petitioner along with Rajesh Jha assaulted the husband and Dewar with knife on his head. Petitioner also broke the hand of the husband of the informant.
Learned counsel for the petitioner submits that there is a counter version. On account of land dispute this case is lodged. On perusal of the order of the learned sessions Judge it appears that incised wounds were found on the head of Govind Jha and Sohind Jha. There is fracture injury also. The petitioner
Patna High Court Cr.Misc. No.49298 of 2014 (2) dt.07-04-2015 2/2 is alleged to have given repeated the blows with knife. Hence I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly the same is rejected. If the petitioner surrenders before the court below, the court below shall consider the case of the petitioner without being prejudiced by the order of this court.
