JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner seeks bail in connection with Town P.S. Case No.557 of 2019 registered under Sections 25(1-b) a, 26 and 35 of the Arms Act.

The accusation is that in course of patrolling duty, when the informant along with other police personnel reached in front of the lane of Sarvodaya Nagar, then one person, on seeing the police party, tried to conceal himself but, on chase, he was apprehended, who disclosed his name as Nitish Kumar Singh alias Bhima (petitioner). One another person, who had concealed himself in a room, was also apprehended from there and he disclosed his name as Kundan Kumar. On search, the

Patna High Court CR. MISC. No.18712 of 2020(2) dt.09-06-2020 2/2 petitioner was found in possession of one loaded country made pistol, five live cartridges and one mobile set, whereas Kundan Kumar was found in possession of one loaded country made pistol and one mobile set.

Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner is accused in four other cases, as detailed in paragraph-3 to this application, in which he is on bail, due to that reason, the police falsely implicated the petitioner in this case showing the recovery of one loaded country made pistol, five live cartridges and one mobile set from his possession. In the present case, the petitioner is in custody since 19.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Town P.S.
