This being the position, this Court, instead of interfering with the impugned order, directs the learned court below to

Patna High Court Cr.Misc. No.46073 of 2014 dt.10-10-2017 proceed with the matter and because it arises out of a matrimonial discord which has now been settled between the parties it would be in the fitness of the things that on appearance of the parties, the case should be taken to a logical end in the interest of justice. The application is disposed of with the observations and directions made above.
